General Terms and Conditions for Use of left luggage and General Terms and Conditions Of Sale for a concierge-left luggage service at Lille Europre station
Preamble
SNCF Gares & Connexions is responsible for operating the Concierge-Left luggage Service at Paris Nord station. As part of its Service offer, SNCF Gares & Connexions offers its Customers Left Luggage Services and related activities.
SNCF Gares & Connexions has entrusted a Service provider with fulfilling this Left Luggage and Concierge Service.
The present Terms and Conditions of Use (TCU) and Terms and Conditions of Sale (TCS) set out the terms and conditions under which the Gares & Connexions Service provider offers its Left Luggage and Luggage portering Service, sale and rental of various items and under which the Customer uses the Services offered.
Use of the Services offered implies full and complete acceptance of the present TCUs and TCSs by the Customer.
Article 1 - Definitions
The words or phrases used within the TCUs and TCSs beginning with a capital letter, in the singular or plural, will have the following meaning:
Luggage: refers to any type of suitcase, bag or other form of container used to transport personal belongings or travel items. Certain items, designated as XL Luggage, such as scooters, bicycles, surf boards, skis, etc. are subject to specific pricing.
Customer: any physical or moral person using the Services
Left Luggage: Service that involves receiving, secure storage and return of Luggage of Customers. This Service also includes security checks, management of Left-luggage tickets and all other operations related to reception and return of Luggage
Left-Luggage Fee: refers to the fixed amounts for storage and safekeeping of Luggage left by a Customer either based on the storage time or the type of Luggage, notably for oversized items, XL size.
GDPR: refers to the General Data Protection Regulation and makes reference to the European regulatory text that governs data processing uniformly across the whole of the European Union (EU) which came into force on 25 May 2018.
Article 2 - left-luggage service at stations
2.1 Left-Luggage Service
The Left-Luggage Service, implemented by the SNCF Gares & Connexions Service provider, manually takes the Luggage of Customers after undergoing a security check and stores it in a secure place.
This Service enables passengers to drop off their Luggage for a period of their choosing up to a maximum of 15 days.
The manual Left-Luggage Service is in a secure place equipped with CCTV where the Customer is served by staff with whom they deposit their Luggage.
For security reasons, the Customer may be asked to open their Luggage for a security check.
The Customer must put their Luggage on the X-ray conveyor so that the accredited security agent can check for illicit or forbidden items. In case of refusal, the deposit will not be authorised.
It is forbidden to deposit the following items in Left-Luggage:
- products regarded as dangerous;
- explosive, flammable or toxic materials,
- refillable gas canisters;
- firearms;
- bladed weapons;
- perishable foods;
- live animals.
The Gares & Connexions Service provider will take all appropriate measures to ensure they are able to identify the Luggage deposited by each Customer and thus be able to return Luggage to Customers.
2.2 Procedure for Deposit and Return of Left Luggage
A numbered ticket is provided when depositing Luggage which is required for return of Luggage.
In case of loss of the ticket, proof of identity is required to collect the Luggage.
If the initial storage time has been exceeded, additional fees will apply in the form of a charge of €6 per additional day per item of Luggage.
The maximum storage time is 15 days.
Beyond this time, the Luggage is considered to be left without protection, they are stored in a dedicated place not in the lockers for a period of 6 months before being donated to charities.
2.3 Left-Luggage opening hours
The Gares & Connexions Service provider informs its Customers about the opening hours of its Left-Luggage Service, which are available on location, as well as on the Gares & Connexions website and communications.
It is the Customer's responsibility to find out about the opening and closing times of the Left-Luggage in order to plan when to drop off and collect their Luggage accordingly so as to avoid any inconvenience.
Article 3 - Fees
The services are provided at the current rates displayed in the premises used by the SNCF Gares & Connexions Service provider. It should be noted that the Service provider, as with all agents working for SNCF, shall not accept any tips.
3.1 Left Luggage
For a period of less than 4 hours, the rate per item of Luggage is €4.
For a period between 4 hours and 12 hours the rate per item of Luggage is €7.50.
For a period between 12 hours and 24 hours, the rate per item of Luggage is €9.50.
If the end time of a left luggage service is outside the opening times, the customer may pick up their luggage the next day, at the latest 1 hour after opening.
If the storage period is exceeded on the planned pick-up day, €6 shall be charged per item of Luggage for the rest of the day. A 30 min maximum overrun is tolerated.
A fee of €6 shall be charged per item of Luggage per additional 24 hours up to a maximum of 15 days monitored and up to 6 months before being donated to charity.
For specific items, designated as XL Luggage (bicycles, musical instruments, skis, surf boards, pushchairs), a fee of €15 is required per item per 24 hours, regardless of the storage time, up to a maximum of 15 days monitored and up to 6 months before being donated to charity. If the storage period is exceeded on the planned day of collection, €6 shall be charged per item of Luggage for the rest of the day.
3.2 Payment
The accepted payment methods are : bank card (CB, Visa and Mastercard on the bank payment interface, secured via an encryption certificate) and cash.
Article 4 - Intellectual property
In general, no provision of these General Terms and Conditions can be interpreted as granting the Customer, expressly or implicitly, any right (by way of a licence or any other means) to the names, brands, acronyms, logos, and other distinctive signs of SNCF Gares & Connexions or any other right of its Service provider, particularly when related to literary and artistic property.
Failure to respect these restrictions may constitute an act of counterfeit and/or illegal and interfering competition, invoking the User's civil and/or criminal responsibility.
Article 5 - Liability
5.1 Liability - general principles
The liability of SNCF Gares & Connexions with regards to the Customer shall only be invoked for actions directly attributable to it and that have caused harm directly related to these actions. It may not be invoked for indirect harm.
The Gares & Connexions Service provider shall not be held liable for damage resulting from force majeure or events outside of its control.
The Gares & Connexions Service provider shall endeavour to provide a fast and effective Service when it comes to Left-Luggage. Nevertheless, the Gares & Connexions Service provider shall not be held liable if a Customer misses their train due to crowding or waiting at the Concierge-Left Luggage facility.
It is the Customer’s responsibility to anticipate and plan sufficient time to collect their Luggage or rented Products and get to their departure platform. The Gares & Connexions Service provider recommends that Customers take into account potential waiting times, especially during particularly busy periods.
The Gares & Connexions Service provider shall not accept any liability for consequences resulting from such delays, including but not limited to a failure to meet transport obligations (such as missing a train).
5.2 Liability – Left-Luggage
The Gares & Connexions Service provider receives Luggage belonging to other people. It has a duty to store it and return it in the same condition when the Customer comes for it if the Customer comes before the maximum time agreed when depositing the Luggage.
It has a responsibility to store and return deposited Luggage in the condition that it was in on the day of deposit. The Gares & Connexions Service provider is the custodian of the deposited goods, in accordance with articles 1915 and seq. of the French civil code concerning contracts of bailment.
The Customer is responsible for the content and condition of their Luggage.
The Gares & Connexions Service provider shall not bear any liability if the Customer is unable to collect their Luggage due to arrival outside of the Left-Luggage opening hours.
The Gares & Connexions Service provider shall not bear any liability for forbidden or dangerous items, or for pre-existing deterioration of Products.
When a Customer deposits Luggage in the Left-Luggage facility they accept that the bag is secure and inaccessible until the end of the agreed storage period.
If the Customer wishes to access their Luggage to retrieve an item before the end of the initially agreed storage period they understand that this shall terminate the current storage. No reimbursement in full or in part shall be paid for the unused storage period due to the premature interruption to retrieve items. The applicable fees for the new storage shall be paid upon the new deposit.
Article 6 - Contact
If the Customer has any requests or complaints regarding use of Services, they may contact the Gares & Connexions customer service by going to the ‘Need help’ section of the www.garesetconnexions.sncf website or on the Ma Gare SNCF app.
Article 7 - Invalidity of a clause
The invalidity in whole or in part of one or more of the provisions of the TCUs and TCSs, under the terms of a legal or regulatory provision or a legal decision that has become definitive does not lead to the invalidity of the other provisions or the part of the provision that is not invalid.
Article 8 - Applicable law - Settlement of disputes
The TCUs and TCSs are subject to French law.
In the event of disputes relative to the interpretation, validity or implementation of these T&Cs and TCSs, the Customer and SA SNCF GARES & CONNEXIONS agree to make every effort to resolve the matter amicably.
In the event that an amicable agreement cannot be found, any potential dispute relating to interpretation or implementation of the TCUs and TCSs shall be subject to the judgement of the Paris courts.
